| Sheboyan man gets 18 months for sex with disabled teen Sat, 03 May 2008 14:10:00 CST SHEBOYGAN A 44-year-old Sheboygan man who admitted having sex with a mentally disabled teen was sentenced Friday to 18 months in prison after confessing his love for the girl while asking the judge for leniency. Juan Aguilar, an illegal immigrant who had been living at 1523 Indiana Ave., met the girl at a Laundromat near his home, according to a criminal complaint. The girl is a 17-year-old with the mental capacity of a third- or fourth-grader, court records show. Aguilar told Judge James Bolgert that the girl loved him, came to visit him on her own free will and consented to the sexual contact. I never abused her. I always took care of her. I dont want to cause her harm, Aguilar said in a written statement read by an interpreter. I would like to ask you to give me the smallest punishment, because I never abused the miss. She would come to my house every day to eat. We didnt always have sex. I took care of her. Aguilars attorney Thomas Gerleman, asked Bolgert to sentence Aguilar to probation only, and Assistant District Attorney Jim Haasch recommended two years in prison. Aguilar faced a maximum of 36 years behind bars after pleading no contest to two felony counts each of child enticement and causing a child to view sexual activity under a plea agreement that dismissed 10 misdemeanor offenses. Aguilar told police he and the girl watched pornography together on at least two occasions, the complaint said. Gerleman urged Bolgert to be lenient pointing out Aguilar has no criminal history and worked to send money to his family in Mexico but Haasch said such factors do not alter the seriousness of the offense. Society and its representatives have determined that crimes against children are extremely serious, Haasch said. The defendant certainly knew, or should have known, of the limited capacity of (the victim). That I think compounds the charges. According to the complaint, Aguilar brought the girl to his house on several occasions, having sex at least five times between Oct. 1 and Dec. 1. The girl told police that Aguilar bought her soda and candy after the two met at The Wash House, 1602 Indiana Ave., and gave her a diamond necklace for her birthday, the complaint said. Aguilar said the girl performed a variety of sex acts, according to the complaint. The sexual contact was reported by a guidance counselor at a city school. The victims mother was in the courtroom for Aguilars sentencing but did not testify. Haasch said she told him the girl is struggling to cope with the situation. The scars, the difficulties, the trauma, the anxiety that the victim faces are lifelong, Haasch said. Bolgert said he considered Aguilars character in sentencing, but also took into account the girls condition. Aguilars expected deportation at the end of his prison sentence was also a factor, the judge said. Bolgert said Aguilar, after leaving prison, will be held for several months in a deportation center in Illinois and then sent back to Mexico. He will not serve the two years extended supervision imposed by Bolgert. |

(AP) A 28-year-old woman shot her 8-year-old daughter in the thigh with a BB gun to win a $1 bet with her boyfriend, according to authorities. Angelique R. Vandeburg was charged with one felony count of intentional child abuse. She made an initial court appearance Friday and was released on a $5,000 signature bond The girl told police the shot hurt so much that she couldnt walk, according to a criminal complaint. Her mother and the mothers boyfriend had been drinking heavily before the boyfriend offered Vandeburg $1 and handed her the gun, prosecutors quoted the girl as saying. The complaint provided the following account of the incident: Investigators began looking into the incident Wednesday after a school counselor reported it to police. The girl had been shot three or four days earlier, on April 26 or 27, but a circular bruise remained visible on her thigh, the counselor said. The girl said the shooting occurred in her mothers bedroom after her mother had 10 to 12 beers. The boyfriend bet the mother $1 she wouldnt shoot the girl. The mother responded by taking the gun and shooting the girl, who was wearing three pairs of pants. The BB deflected off her leg and struck her 7-year-old brother, who wasnt injured. The boyfriend then grabbed the gun, ran from the house and drove away. Vandeburg told her daughter to keep quiet about the incident, saying it was a family thing and that the mother would go to jail if the girl told. The complaint quoted Vandeburg as telling a police detective the girl was lying to get her in trouble. She said the girl suffered the bruise three weeks earlier when she fell from her bike and hit her leg on the handlebar. |

(AP) With general manager Ted Thompson preferring to view the NFL draft as a long-term investment rather than as a way to immediately fill holes in the roster, the Green Bay Packers early-round picks have often spent more time on the bench than on the field early in their careers. Last year, for example, first-round pick Justin Harrell was inactive for nine of the first 11 games of the season second-round halfback Brandon Jackson started the first three games but was inactive for the next four and only a bit player thereafter and even though third-round wideout James Jones earned the No. 3 receiver job, third-round safety Aaron Rouse was inactive for the first three games and played only on special teams the next five. This year, its possible that a deep receiving corps will keep top pick Jordy Nelson low on the depth chart early on, and if new starting quarterback Aaron Rodgers is effective and healthy, second-round pick Brian Brohm wont see action. But both third-round tight end Jermichael Finley and second-round cornerback Patrick Lee, given the Packers needs at their respective positions, clearly have an opportunity for immediate playing time. So while this weekends post-draft rookie orientation camp has 36 rookies nine draft picks, 11 undrafted free-agent signees and 16 of the 19 tryout invitees getting their first taste of an NFL practice, Finley and Lee could end up seeing the most action from scrimmage. Finley joins a tight end corps that previously consisted of just two: starter Donald Lee and Tory Humphrey, whos yet to catch a pass in the eight regular-season games hes played in three years. Humphrey missed all of 2007 with a broken ankle. Patrick Lee, the third of the Packers three second-round picks, joins a cornerback group that has Pro Bowl veterans Charles Woodson and Al Harris entrenched as the starters. Beyond that pair is a free-for-all for the No. 3 cornerback job a position thats used on about 50 percent of the defensive snaps because of how often the nickel defense is employed. Finley admitted he kept an eye on the tight ends on the Packers roster after the team expressed an interest in him at the scouting combine in Indianapolis in February. Although the Packers added two undrafted tight ends after the draft, Finley could be the teams No. 2 tight end in September. While the Packers havent told Finley about his chances of playing right away, they didnt have to. Theyre not really telling me anything. Theyre just telling me to go out and work hard, said Finley, who came out of Texas following a redshirt sophomore season in which he caught 45 passes for 575 yards and two touchdowns. (But) looking at the tight end position, Ive got a big chance of coming in and playing. Lee, meanwhile, knows about Woodson and Harris, but when asked about his competition for the third corner spot holdovers Tramon Williams, Jarrett Bush and Will Blackmon all held the job at different times last season Lee said hes yet to call up Packers.com and peek at the depth chart. I never looked at that. I still havent looked at that, said Lee, who started five games as a sophomore in 2005, then played only in sub defenses before regaining his job and starting all 13 of Auburns games as a senior last year. Id love to contribute in any way special teams, anything and everything. Im going to be ready. I want to be actually on the field and make plays. Even though there would appear to be more urgency to getting Finley and Lee ready to play compared to Nelson, Brohm or offensive linemen Josh Sitton and Breno Giacomini, coach Mike McCarthy said Finley and Lees learning curves wont be accelerated. I think the opportunities for any young player usually come through special teams (first), McCarthy said. They probably wont be treated any differently. But the progression of how theyre taught and the opportunities that will come to them first, we just have to get them ready for that. |
